"Mr. Lynch receives no negative consequence for failure of any of his assurances, but tens of thousands of vested residents unrepresented in the KBRA/KHSA who know the unaccountable environmental promises are lies have been and will be those subject to the greatest confiscation and uncompensated loss of environment, lives, and futures."

Reg LeQuieuMallams' use of water didn't short anyone; Project irrigators got the water they were told they would get, H&N commentary by Reg LeQuieu, Klamath County and retired Klamath County Assessor, posted to KBC 10/30/15. "Mallams’ well is over a half mile from the Sycan River and over two miles from the Sprague River...there is no evidence that using his well somehow reduces the flow of the rivers..."

NOTE by Klamath County Commissioner Tom Mallams, "The other additional piece of this puzzle is the relationship between the administrative rule that ties ground water and surface together, and the settlement agreements. The administrative rule is by it's own definition, 'consistent with the settlement agreements.' Also, with lack of legislation moving the settlement agreements forward, this very administrative rule, by its own language goes away. In other words, OWRD is turning well water off under authority of an administrative rule which is dependent on legislation that has not happened, and likely never will. Another government example of "THE CART BEFORE THE HORSE!"

The West's water rights system is working, by Family Farm Alliance Dan Keppen and Patrick O'Toole, Denver Post, and Klamath Herald and News, posted to KBC 10/15/15. Side by side is a small KBC News collection of efforts made by Dan Keppen, and also letter by Family Farm Alliance, supporting the controversial Klamath Basin Restoration Agreement / KBRA, which effects Klamath Basin water management, private water rights, downsizes agriculture and destroys infrastructure (hydro dams). Tom Mallams responds to charges, Klamathnews.net, posted to KBC 10/15/15. "Within the notices, we were allowed 60 days to file a Petition for Judicial Review, which by definition is an "instant stay". Their final notice, dated August 25th, which we received on the 28th, gave us until August 31st to comply...The truly sad part of this is that the H&N knew all these facts while they were claiming my wife & I were "stealing water"from our neighbors..."

"A proposal for an inventory and market assessment for a tribal timber and wood biomass resources was awarded $113,832. Another proposal for a pre-development study for two large solar installations was granted $118,500."

"County Commissioner Tom Mallams should be congratulated for his leadership in opposing the Oregon Water Resources Department’s (OWRD) heavy-handed and arguably unauthorized regulation of irrigation wells, by administrative fiat."

Mallams: water use allowed during appeal, H&N, guest commentary by Klamath County Commissioner Tom Mallams, posted to KBC 10/5/15. "Recently, a certain reporter accused me of breaking the law and ignoring water shutoff notices. The law allows all water users, including myself, to challenge an incorrect regulation order and prove that my well does not interfere with earlier priority surface water uses. All regulation orders have been “stayed” while I seek judicial review, allowing water use while the court decides my case.I believe in obeying the laws of the land, and no, I am certainly not above the law. I also believe in the right to protest and challenge unjust laws and regulation including unjust administrative rules."

"Last week Ilo and Melissa Ferroggiaro (owners of Laughing Lotus Farms, a medical marijuana dispensary) filed a recall petition...Daugherty said recall petitions and petitions to overturn the ban on county marijuana sales will be available to sign...(Mallams) noted those needing medical marijuana will still have access to it at shops within the city of Klamath Falls."
