The following are comments to the Klamath Facilities Removal, Public Draft, EIS/EIR by Werner F Hoyt, Mechanical/Marine Engineer, pdf 12/30/11. HERE for Word Document. . "...The basic premise of the removal is the requirement is to restore upper basin as salmon and steelhead habitat is a predetermination of the KRBA. Evidence not presented in the EIS/EIR is that there was not habitat above Keno due to the reef at Keno. In absence of the Keno Dam the natural reef would prevent any migration further into the Klamath basin. Coho were introduced in 1895 by DFG...."

"They have a unique negotiation strategy; refuse to participate in litigation, so they have no chance of prevailing in court; agree to support the Klamath Basin Restoration Agreement, which supports granting the tribes what they want up front, (dam removal, 92,000 acres of deeded land, millions in fishery money, etc.), thereby surrendering potential leverage, without guaranteed protection from tribal in-stream claims."

"These unprecedented forest fuel loads have been the direct cause of uncontrollable wildfires that have consumed millions of acres of Oregon forest lands, and ironically, millions of acres of Northern Spotted Owl habitat."

River Access on Reservation Denied (by Hoopas to non tribal people), Two Rivers Tribune 12/29/11. “The reservation has always been open access for fishing as far back as I can remember,” Duggan said. “There’s people who have been fishing down there since the ‘40s. We’ve got people that come from all over the state and some from out of state to fish for steelhead.”

Cabin owners tepid on well settlement offer, PacifiCorp’s proposal follows breach of Condit Dam, The Columbian 12/25/11. "cabin owners sent a letter to PacifiCorp saying they believe the utility is “100 (percent) liable for all property damages incurred due to removal of the lake. PacifiCorp, which owns the land around the former reservoir and leases 53 cabin sites near Condit Dam, disagrees."
Well owners want PacifiCorp to pay more for damage done by removal of Condit Dam, Oregonian, posted to KBC 12/27/11. "The hoopla over dam removal has left cabin owners feeling overlooked, Lease said. They could try to take their case to court, he said, but they would be up against a company with significant legal resources. Land owners around other dams being considered for removal should pay attention, he said. PacifiCorp is scheduled to take down four dams on the Klamath River in 2020."

Tribes position in water settlement clarified, H&N 12/17/11. “The Tribes have not in any way agreed to exchange their time immemorial priority date for a 1908 priority date. The KBRA does not make decisions about priority dates and the amount of water anyone has a water right to — that is the jurisdiction of the adjudication. Instead, the KBRA is an arrangement between the Tribes and the Project irrigators that lays out how each party will behave in regard to water rights calls and diversions.”
