This Notice is being sent by the California Water Boards on behalf of the U.S. Environmental Protection Agency.  

The following U.S.EPA Notice of Availability for California’s 2008-2010 Section 303(d) List refers to the California 2010 Integrated Report [Clean Water Act Section 303(d) List and 305(b) Report] that the State Water Board submitted to U.S.EPA for final approval on October 13 2010.  If you would like to view the California 2010 Integrated Report that was submitted to U.S.EPA, it is posted on the State Water Board website at: http://www.waterboards.ca.gov/water_issues/programs/tmdl/integrated2010.shtml

Section 303(d)(2) requires that states submit, and U.S.EPA approve or disapprove, lists of waters for which existing technology-based pollution controls are not stringent enough to attain or maintain state water quality standards, and for which total maximum daily loads (TMDLs) must be prepared.  On November 12, 2010, U.S.EPA approved California’s 2008-2010 Section 303(d) list of impaired waters requiring TMDLs, and disapproved the omission of several water bodies and associated pollutants that meet federal listing requirements.  U.S.EPA identified additional water bodies and pollutants for inclusion on the State’s 303(d) list.  

U.S.EPA is providing the public an opportunity to review its decisions to add waters and pollutants to California’s 2008-2010 Section 303(d) List.  U.S.EPA will consider public comments received, and may revise these decisions if appropriate. U.S.EPA solicits public comment only on these additional waters and associated pollutants added to California’s 2008-2010 Section 303(d) list.  U.S.EPA will prepare a responsiveness summary that demonstrates how public comments were considered.

The public comment period will begin upon publication in the Federal Register, and remain open for 30 days.  The deadline for receiving comments will be posted on the website below upon publication in the Federal Register.
