According to a letter submitted by the Siskiyou County Water Users Association (SCWUA) – the petitioners in the case – the suit was brought against those agencies, alleging that they had violated the California Environmental Quality Act when signing the Klamath Hydroelectric Settlement Agreement and Klamath Basin Restoration Agreement.
The case is currently before the Sacramento Superior Court.
At the meeting Tuesday, the SCWUA will ask the board to consider putting $40,000 toward supporting the case, which asks the court to “issue a permanent injunction enjoining any further action with respect to the agreements, as well as a declaration that approval of the agreements violated CEQA and they are therefore void.”
According to the agenda worksheet, no funding source has yet been identified.
The board of supervisors meeting starts at 10 a.m., with the discussion of the SCWUA request scheduled for 1:30 p.m.
