Powers of Control/Settlement Agreement
by James Waddell, Karuk tribal member, posted 3/13/08 I write to inform you folks of a better meaning of my thoughts of the "Powers of Control." If a county signs this inappropriately called "Settlement Agreement" that county will volunteer to relinquish its authority over virtually all of that county's business activities.
If this "Bad" agreement is signed onto as an agreement... the
signing will give American Natives control of Klamath River
water, its tributary water, spring water, well water, water
table water and take away all water rights of all citizens. Any
business or government projects or activities of citizens' lives
that may be construed as diminishing these "Water Rights" can be
stopped or sued by these new water rights holders.
All water rights of all citizens will be thrown out of
existence; from ranchers and farmers to homebuilders, building
permits, city planning, road work, lot splits, logging, hunting,
or even fishing, all can be proclaimed as diminishing these
"New" Native American controls.
Remember, this means all the land and water from Klamath Marsh
to the distant reaches of the South Fork of the Trinity River...
from Crater Lake to the Pacific Ocean, all water rights of the
river itself to ground water and well water will be under the
control of somebody besides the county government of the land of
its existence.
That is what I believe at this time.
