Irrigation districts file Klamath agreement
validation request
Klamath County, Ore. — In an action
mirroring that already undertaken in California, three
irrigation districts in Oregon are looking to have their
actions validated by the court with respect to executing
the Klamath Hydroelectric Settlement Agreement (KHSA)
and the Klamath Basin Restoration Agreement.
The Tulelake Irrigation District currently has an action before the Siskiyou County Superior Court requesting validation of its actions in signing the two agreements, as required in the KHSA, and according to a notice posted in Klamath County’s Herald and News, the Klamath Irrigation District, Malin Irrigation District and Shasta View Irrigation District have all filed a similar request in the Klamath County circuit court. According to the notice, the irrigation districts are asking “for a judicial examination judgment of the court as to the regularity and legality of the authorization of two contracts with the United States of America and other parties and the validity of said contracts.” The notice states that individuals in the districts, including freeholders, legal voters and assessment payers, can contest the validity of the proceedings or file a response brief in the Klamath County court within 10 days of the final appearance of the notice in the newspaper, which is Jan. 23. The current validation request before the Siskiyou County court has not been acted upon by the court, however, it was opposed by Siskiyou County, which has a dismissal request pending. – David Smith can be reached at dsmith@siskiyoudaily.com |
