Assembly Bill 1032 has just gone through a
very substantial amendment. For the most part, they have
stripped out the language concerning wild trout and heritage
waterways, and have replaced it with language to either
eliminate or further-restrict suction dredging on a long
list of waterways in California.
In Siskiyou County, the new AB 1032 eliminates suction
dredging on the main stem of the Salmon River, Elk Creek,
Indian Creek and other waterways. It reduces dredging
seasons along the Klamath & Scott Rivers and the North &
South Forks of the Salmon River to a 2-month season each
year; July and August.
The new AB 1032 also eliminates suction dredging activity on
all or part of the following gold-bearing waterways further
to the south of us: Truckee River (Nevada County),
Stanislaus River (Tuolumne County), Rubicon River (Placer
County), North Fork American River (Placer County), Merced
River (Mariposa County), Lavezolla Creek (Sierra County),
Feather River (Butte and Plumas County) and others.

Please spread the word around, because there will be
thousands of property owners affected by this who
probably are not even aware of the pending legislation!
We have hired excellent lobbyists in Sacramento who
are working very hard to kill this bill (behind the
scenes) so that it never gets signed into law. Our
attorneys are also directly involved and gearing up to
challenge AB 1032 if it does get signed into law! I am sorry
to not give very many details about what we are doing. The
reason is that our adversaries watch our communication
forums closer than our supporters do! Consequently, they
were able to counter our earlier attempt to kill AB 1032 in
the Senate Natural Resources Committee. What a fiasco!
I ask that you have some faith that we have very
competent attorneys and lobbyists working this problem as
well as can be done under the circumstances. Watch for an
Action Alert which is coming soon that will ask for your
direct participation.
I also am asking for your financial contributions. So far,
we have been making most of the payments to our
professionals out of the New 49’er general fund. Industry
contributions are not keeping up with our costs in
defending against this terrible bill. We need help, even if

the formal proceedings.
We have been in tight spots before and have ended up on top.
This latest amendment creates a clear-cut taking of the
productive use of enormous property holdings without
providing any demonstrable benefit to the public.
Imagine these guys thinking they can just take so much
private property away without so much as an explanation!
There are some serious problems with the legislation
as written. As long as we hold ourselves together, it is a
good chance we will end up on top when this is all over.
