The State Assembly Water, Parks, and Wildlife
Committee is expected to vote on SB 252 (Dodd,
D-Napa) tomorrow, Tuesday, June 27.
This legislation would:
- Create a state mandate on the local
management of water basins;
- Hinder local efforts to achieve
sustainability in each basin; and
- Threaten property rights.
It's urgent to tell your Assemblymember to vote
NO on this bill before the vote tomorrow!
SB 252 was amended earlier this month to mandate
an applicant seeking a new well permit, in a
city or county overlying a basin in critical
overdraft condition, to follow onerous
procedures for securing a well extraction
permit. In addition, if passed, SB 252 would:
- Undermine the goal of achieving
groundwater sustainability through local
management by taking decision-making away
from locals in critically over-drafted
basins;
- Dictate to property owners which
groundwater extractors may pull groundwater;
- Fundamentally changes common law
concerning groundwater disputes in reference
to all groundwater basins, potentially
creating costly and burdensome basin-wide
groundwater adjudications;
- Imposes significant burdens on well
applicants that could ultimately open the
door for costly litigation;
- Requires cities and counties to amend
their current groundwater well ordinances to
require a public notice and comment period
for EACH groundwater well application,
undermining local efforts to manage
groundwater in critically over-drafted
basins.
Under SB 252, the following counties
would be required to amend their existing
groundwater well application ordinances:
Fresno, Inyo, Kern, Kings, Madera,
Merced, Monterey, San Bernardino, San Joaquin,
San Luis Obispo, Stanislaus, and Tulare
Counties.
