Klamath plan Scots protest despite US court setback

FOUR tribes of native Americans have suffered a major setback in their $1bn legal action against ScottishPower's US subsidiary over alleged damage to their salmon fishing grounds.

Last Thursday a federal district court judge in Oregon affirmed a magistrate judge's opinion delivered in May, recommending dismissal of the lawsuit against PacifiCorp on the grounds that it was untimely.

The Klamath tribes, who plan to demonstrate at Scott-ishPower's annual meeting this week, for the second year runn-ing, are thought likely to appeal.

A spokesman for ScottishPower said: "PacifiCorp believes that the decision is appropriate. However, it will continue to work with the Klamath tribes and the many other interest groups on the complex issues affecting the Klamath basin."

The tribes launched their $1bn action against PacifiCorp in US District Court in Oregon in May last year, alleging that hydro-electric dams have ravaged a California salmon river. The Karuk, Yurok, Hoopa, and Klamath tribes allege that PacifiCorp and its predecessors affected their federal treaty rights to fish for salmon in the headwaters of the Klamath river in southern Oregon by building dams that blocked the passage of salmon upstream.

A 15-strong delegation from the tribes will attend ScottishPower's annual meeting, following on from a visit last year, during which they confronted the company's board and secured a "personal commitment" to find the right solution from Ian Russell, the group's chief executive.

This year the tribes are planning a documentary film screening in Edinburgh and a traditional salmon bake ceremony, as well as demonstrat-ions outside the meeting at Glasgow's Royal Concert Hall.

The native Americans have accused ScottishPower of selling them down the river by engaging in negotiations while planning to sell PacifiCorp and its dams. They claim the company has had sufficient time to make good on its pledge.

ScottishPower agreed the $9.4bn sale of PacifiCorp to billionaire US investor Warren Buffett in May this year.
