The Contested Case proceedings for the COB Energy Facility have been going on during June and July by correspondence. Various attorneys and expert witnesses have been submitting required filings, affadavits and responses. There have been telephone calls and e-mails to set up the schedule for the cross examination phase which will take place July 28th at 9 a.m. in County Commissioners hearing room in Klamath Falls at 305 Main Street, Room 219. Although there will be no opportunity at this hearing for public comment, we are all invited to come and watch the proceedings.

There are a number of additional steps after the cross-examination concludes before the Hearings Officer makes a decision. Attorneys submit final briefs in mid-August. The Hearings Officer is scheduled to issue her proposed order on September 3. Then the parties file "exceptions" which are objections to the Hearings Officer Order. Then the Energy Facility Siting Council holds a hearing and makes a decision probably in mid-Oct.

After a final telephone conference today to schedule witnesses, it appears that this hearing will not take three days. Those of us opposed to the facility being sited in Langell Valley have submitted legal evidence and affadavits on some points that COB has not addressed. It is better in some cases not to get their witnesses on the stand. After the schedule was set for the witnesses being called, it appears that this part of the proceedings may not take three days, in fact it might be able to be completed in one day. So if you plan to attend we encourage you to be there Wednesday. It is scheduled to begin at 9 a.m. The only witness scheduled at a time certain is Jerry Grondin of Oregon Water Resources and he is scheduled for 2 p.m.

Klamath County Board of Commissioners has scheduled meetings to discuss the proposal of extending the current Enterprise Zone out Hwy. 140 E and Hwy. 70 to the proposed COB Plant site.

The meetings: first at Klamath Falls City Council - Monday, Aug. 16th, 7 pm at the Klamath Falls City Council Chambers;

Klamath County Commissioners will hold another meeting on Tuesday, Aug. 24, 10 am, at the Klamath County Commissioners Hearing Room.

People's Energy has requested the Enterprise Zone be extended to the site, and is also requesting a tax break for 15 years in return for a commitment of paying $1 million a year for the 15 years to Klamath County. People's Energy would save an estimated $71.3 million in taxes on the project during that same period.
